Medical marijuana was legalized in California in 1996, and patients could access it in 1997. A formal medical marijuana licensing structure was not created by statute until 2015. In November 2016, residents voted to legalize recreational marijuana. On January 1, 2018, the state’s regulated dual- medical and recreational marijuana market opened with temporary licenses for all cultivators, manufacturers, distributors, testing laboratories, micro businesses, and retailers.
The state’s cannabis industry is regulated by three separate agencies: the Department of Food and Agriculture regulates cultivation facilities, the Department of Public Health regulates manufacturers, and the Bureau of Cannabis Control regulates testing, distribution, and retail sales.
Local municipalities have the ability to tax, ban, and otherwise regulate cannabis businesses within their jurisdiction.
